Terms and conditions of sale
Article 1 - Length of stay
A reservation is made for a given period. Unless otherwise agreed with us, LES BRUYERES DE GASCHON, it cannot be brought forward or extended. Under no circumstances may the customer claim any right to remain in the property at the end of the stay.
Article 2 - Prices
Prices are quoted in euros and are only valid on the date of booking.
The price of an overnight stay in an unusual accommodation is quoted for 2 people. It includes breakfast and bed linen for bookings of less than 3 nights.
The price of an overnight stay in a gîte is quoted on the basis of 2 people, to which should be added the price of the extra person(s) if applicable. Breakfast is included in the price for bookings of less than 3 days.
Tourist tax is not included.
Article 3 - Booking
Bookings can be made using the online booking form on our website or by telephone. A booking confirmation will be sent to you by e-mail.
Article 4 - Validation of a reservation
Stays are only guaranteed once payment or a voucher has been received.
Full payment is required on booking.
Bookings made on our website imply acceptance of these general terms and conditions of sale.
Customers may not validate their booking on our website without declaring that they have read these general terms and conditions of sale when making the booking.
Clicking on the booking validation box constitutes an electronic signature, equivalent to a handwritten signature in the contract between buyer and seller.
The booking becomes firm and definitive when the payment and/or the sending of the voucher is recorded and validated.
Article 5 - Cancellation conditions
All cancellations must be notified by registered letter. Cancellation by the customer will incur, in addition to the booking fees, the retention of sums corresponding to variable costs depending on the nature of the holiday and the date of dispatch of the notification by registered letter with acknowledgement of receipt. Unless otherwise stated:

cancellation more than 30 days before the start of the holiday: refund or postponement

cancellation less than 30 days before the start of the holiday: 35 % of the price of the holiday will be retained

cancellation less than 7 days before the start of the holiday: 100 % of the price of the holiday will be retained

cancellation due to hospitalisation: refund or postponement with medical certificate
No refunds or discounts will be given for late arrivals or early departures.
No-shows will not be reimbursed. The balance of your stay is due and payable.
Article 6 - Cancellation policy (Table d'hôtes)
Services that have been pre-booked are also subject to certain cancellation conditions:
- Table d'hôtes: In the event of cancellation less than 72 hours before the event: no cancellation or refund will be made.
Article 7 - Accommodation capacity
Reservations are made for a defined maximum capacity. If the number of participants exceeds the capacity, the service provider may refuse to accept additional occupants, in which case the reservation is deemed to have been cancelled by the customer. In this case, the price of the reservation is retained.
Article 8 - Transfer of the reservation by the customer
The reservation must be transferred at cost price between the transferor and the transferee. The purchaser may transfer his reservation to a transferee who fulfils the same conditions as he does for the holiday. In this case, the purchaser must inform LES BRUYERES DE GASCHON of his decision by registered letter with acknowledgement of receipt at least 7 days before the start of the holiday. The transferor is jointly and severally liable, vis-à-vis the vendor, for payment of the balance of the price, as well as any additional costs incurred by this transfer. These additional costs must be paid by the transferor.
Article 9 - Special cancellation conditions for bad weather
Modification or cancellation of your holiday by LES BRUYERES DE GASCHON before or during your stay: In the event of an orange weather warning, with external events beyond our control, such as bad weather, storms or very violent thunderstorms, snow or heavy frost, the management reserves the right to cancel your holiday, for safety reasons. In this case, we will offer you the option of rescheduling your stay, identical to the service booked, to a later date and under the same conditions, within the current 12 months. No other compensation may be claimed.
Article 10 - Arrival and departure times
On the day of your arrival, you will be welcomed between 4pm and 8pm.
All arrivals after 8pm, not agreed in advance, will not be accepted and will incur an additional charge of €20.
On the day of departure, accommodation must be vacated by 10.00 am at the latest. An additional €20 will be charged for late departures.
Article 11 - Payment and settlement of any outstanding balance
Failure to pay in full by the stipulated deadline (no later than the date of your presumed departure) will automatically result in the invoicing of a penalty clause amounting to 15% of the unpaid sum, with a minimum of 50 euros, plus a late payment penalty of 15 % of the total amount of the balance due.
Article 12 - Method of payment
- To pay for your stay and services on our website: payment by bank transfer, cheque or cash.
LES BRUYERES DE GASCHON reserves the right to suspend or cancel a booking in the event of refusal of payment by the banking authorities or in the event of non-payment.
- Payment for services that may be requested after booking on our website can be made on site by cash or cheque.
Article 13- Consumption of services (meals)
The customer must arrive on the day specified and at the time agreed in advance. Any services not used due to a delay will remain due and cannot be reimbursed.
Article 14 - Animals
Pets are accepted under certain conditions. Please contact us before booking.
Article 15 - Use of the premises

All guests are expected to respect a certain art of living to ensure the tranquillity of the place and the comfort of all.

Accommodation non-smoking. If odour nuisance is observed (food, tobacco, drugs, etc...), you may be billed for the cost of restoring the premises.

The customer undertakes to return the accommodation in perfect condition at the end of the stay and to declare any damage for which he/she may be responsible. If any damage is found, the owner will ask for additional compensation for cleaning, repairing or replacing broken items.

Children on the property are the responsibility of their parents.
Article 16 - Civil liability insurance
It is compulsory to be covered by a personal holiday insurance policy, or a specific policy limited to the period of your stay.
Article 17 - Parking
The car park is located on the property. The owner cannot be held responsible for damage to the car or objects inside, or theft of the vehicle or objects inside.
Article 18 - Breakfasts
Breakfasts are included in the overnight rate in unusual accommodation and gîtes booked for less than 3 nights. Breakfasts are prepared between 8.00 and 9.30 a.m., unless exceptionally requested and agreed by us. Breakfasts must be taken with you to be eaten in the gîte or self-catering accommodation.
Article 19 - Table d'hôtes
Meals must be booked at least 72 hours in advance. They are prepared to be taken away between 7.30 and 8.30 p.m. to be consumed in the accommodation occupied or taken at our premises. Any meal booked less than 24 hours in advance will incur a supplement of €5 per person. All meals booked are payable, even in the event of cancellation.
Article 20 - Maintenance of the gîte and unusual accommodation
The house is cleaned and disinfected before your arrival. Accommodation must be left in a clean and tidy condition.
During your stay of more than one night, it must be specified whether you wish housekeeping to be carried out, but you must give us access to your room at least every 2 days if you are renting by the week.
Article 21 - Security deposit
A deposit of €100 will be required on arrival for rental of the gîte for less than 3 days, and €500 for rental of the gîte for more than 3 days. This will be returned to you in full, or if necessary, an amputation will be made to compensate for any damage/breakage. Proof of destruction of the deposit will be sent to you by e-mail no later than 15 days after your stay, if no charge is made.
Article 22 - Information technology and civil liberties
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify or delete your personal data. We undertake not to pass on the information you have given us to other companies or organisations. You can exercise this right by sending us a letter to the following address LES BRUYERES DE GASCHON - 101 chemin du Doux, Lieu-dit Gaschon 43290 Saint-Bonnet-le-Froid.
Article 23 - Tourist tax
The tourist tax is a local tax that the customer must pay to the owner, who then passes it on to the public treasury. It is not included in the price.
Article 24 - Disputes
Any reservation made implies that the purchaser accepts, without restriction, the general terms and conditions of sale of BRUYERES DE GASCHON. Any dispute relating to the sale will be subject to French law before the Commercial Court of Le PUY EN VELAY.
Article 25 - Jurisdiction
Any disputes arising from this contract shall be subject to the sole jurisdiction of the Courts of Le PUY EN VELAY, even in the event of multiple defendants, and French law shall always be applicable.
